Buying a vB4 Forum License... (Quick Question - Needs help badly)

My partner from my forum (http://www.toontownfansite.com)
I'm the owner. But, my partner owns the vB3 license. So, He took over the forum and banned me after all my hard work. So, he kind of used me. I don't want to do anything to ruin it so, I left it alone

and I'm banned from it. I own the domain name and the hosting account. He just owns the vB3 license.
So, what I'm going to do is buy my own vB license. But, I want a vB4 forum license.
So, if I'm going to buy a vB4 license what do I do to get my forum back when I buy it (If it's a vB3 forum?)

Any steps? Any tips? Any advice?
