Despite his serious injury, the public prosecution investigated with him, sentenced him without looking into his serious health condition

Alwefaq Liberties and Human Rights Department expresses its deep concerns about the critical health condition of Ali Ebraheem Kadhim a twenty-year old who was seriously shot by birdshot last Thursday night 17 th May,2012, and his life is believed to be in danger.
Liberties and Human Rights Department confirms that the injuries were at the left side of the neck, shoulder, chest and head. That was after participating in a peaceful protest to as a constitutional right of freedom of speech. Later, he was taken to hospital for treatment , the birdshots caused him cavity surrounding the lung. He was then admitted to an operation).

According to the injured's family, the prosecution representative came to see the injured in Salmanya Medical Complex's ICU. The prosecutor sentenced him 45 days in detention, while the family was not informed about the sentence until the guard at the hospital told them.

The family of the injured added that the police contacted them asking to bring clothes; informing them indirectly about his imprisonment. What was strange is the prosecution ran an investigation without looking into the excessive use of force he was subjected to in an intention to kill him.

Nonetheless, the Ministry of Interior is providing the police with impunity by not questioning them or bringing them to justice leaving them free to commit more violations.

According to the people living there who witnessed the attack; the police brutally attacked the peaceful protest by directly shooting birdshot at the protesters, many were injured, Al-wefaq documented 20 of them while there are many cases still undocumented because they are afraid of being tracked and arrested by the police .

Liberties and Human Rights Department in Al-Wefaq is so shocked at the way the prosecution looked into such a matter. The prosecution investigated only in the right of protesting peacefully and neglected the excessive use of birdshot which was deliberately used to kill the protesters rather than disperse them. This indicates that the impunity provided to the police is behind all these violations and shows that using shotguns is a state's strategy rather than individuals' strategy. Using excessive force is a kind of behavior that is protected by the government itself.

This case is one of many neglected cases in which all violations are continuously committed by the police in the villages. None of the investigations resulted in bringing the criminals to justice. However, many killings and crimes have been committed as the regime is turning a blind eye on what is happening which can be interpreted as a green light for the police to commit more violations.

Liberties and Human Rights Department in AlWefaq has documented many injuries due to shotguns at that night in that area and many areas. It was so obvious that a decision has been made to use excessive force against the pro-democracy protesters at that night.

However, it is highly important that an investigation be opened and the matter be seriously looked into. All those guilty of committing violations must be brought to justice .

The public prosecution is demanded to investigate comprehensively in the brutal assault against Ali.

The public prosecution should substantially present itself as a bastion of rights and freedom which will make it credible to the international community on many issues. It must stress to take advantage from the calls of the international community in Geneva to respect human rights to stop its use of excessive force and impunity to criminals.

Liberties and human rights department in AlWefaq demands for humanistic measures for the victims; who are prevented safe treatment in public hospitals. Instead, the hospital is militarized and wounded protesters are taking to prisons by decision of the public prosecution.
