Search - time between searches

I did a search. Nothing useful came up. I modified the search slightly and got this kick-message:

I understand the need to manage DoS through spamming the search engine, but:

The minimum time between searches should only kick in after the 3rd search.

Alternatively, there is a maximum number of searches X within Y seconds. That gives the maximum flexibility.

vBulletin would currently have X=1, Y=20 seconds

I would have x=3, Y=60 seconds.

The overall server overhead in the two examples (3 searches per minute per user) would be the same, but it would avoid that very annoying "you cant" message 99% of the time. Most genuine users/searches hit the search engine 3 times then go away. No need to keep roadblocking them.
